TERMS AND CONDITIONS / END USER LICENSE AGREEMENT (EULA)

Please read these Terms and Conditions ("Terms") carefully before using the Soul Mechanic Oracle mobile application (the "App"). These Terms also serve as the End User License Agreement ("EULA") governing your use of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account, purchasing a subscription, or otherwise using the App, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you accept and agree to these Terms and our Privacy Policy.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on any Apple-branded or Android device that you own or control, solely for your personal, non-commercial use. This license is granted in accordance with the Usage Rules set out in the Apple App Store Terms of Service and/or the Google Play Terms of Service, as applicable.

3. Description of Service

Soul Mechanic Oracle provides personalized astrology, self-reflection, and "oracle" style readings and guidance, some of which are generated using artificial intelligence. Content includes daily readings, chapter and life-theme insights, journaling tools, and an interactive Oracle chat.

For entertainment and self-reflection purposes only. All readings, insights, and guidance provided by the App are for entertainment and personal reflection only. They are not a substitute for professional advice of any kind, including medical, psychological, legal, financial, or other professional advice. Do not disregard or delay seeking professional advice because of anything you read in the App. You are solely responsible for any decisions or actions you take based on the App's content.

4. AI-Generated Content

Portions of the content are produced by automated systems and large language models. AI-generated content may be inaccurate, incomplete, or unexpected, and does not represent the views of Soul Mechanic Oracle. We make no warranty as to the accuracy or reliability of any AI-generated output.

5. Subscriptions, Billing, and Auto-Renewal

The App offers auto-renewing subscriptions that unlock premium features.

• Pricing: $12.99 per month (Monthly) or $99.99 per year (Yearly). Prices are stated in U.S. dollars and may vary by region and be subject to applicable taxes.

• Payment: Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.

• Auto-renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable rate.

• Managing and canceling: You can manage or cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.

• Free trials (if offered): Any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.

• Refunds: Purchases are handled by Apple or Google. Refund requests are subject to the applicable app store's policies. We do not directly process refunds.

6. Restrictions

You agree not to:

• Copy, modify, distribute, sell, lease, or create derivative works of the App;

• Reverse engineer, decompile, or disassemble the App, except to the extent permitted by law;

• Use the App for any unlawful, harmful, or abusive purpose;

• Attempt to gain unauthorized access to the App, its systems, or other users' data;

• Use automated means to access or scrape the App; or

• Remove or alter any proprietary notices.

7. Intellectual Property

The App, including all content, features, text, graphics, logos, and software (excluding content you submit), is owned by Soul Mechanic Oracle or its licensors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

8. User Content

If you submit journal entries, notes, or other content ("User Content"), you retain ownership of it. You grant us a limited license to store and process your User Content solely to provide the App's features to you. You are responsible for your User Content and represent that you have the rights to submit it.

9. Third-Party Services

The App relies on third-party services, including Apple, Google, RevenueCat (subscription management), and AI service providers. Your use of the App may be subject to those parties' terms. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUL MECHANIC ORACLE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Soul Mechanic Oracle and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, the license granted to you ends and you must stop using the App. Sections that by their nature should survive termination will survive.

14. Apple-Specific Terms

These Terms are between you and Soul Mechanic Oracle only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which Soul Mechanic Oracle operates, without regard to conflict-of-law principles, except where local consumer law requires otherwise.
